I. GENERAL PROVISIONS

1.
Terms and Conditions
These Terms and Conditions apply when purchasing by Befsztyk.pl website. By placing an order on the Befsztyk.pl website the Customer agrees to accept and to be bound by the Terms and Conditions set out below.


2. Technical requirements
In order to use the services available from the Befsztyk.pl website you need to have access to the Internet, have an electronic mail account active (e-mail address) and have a mobile phone. The website will only work correctly if your browser accept „cookie” files.


II. SHOPPING VIA BEFSZTYK.PL WEBSITE

1. Services

Befsztyk.pl offer goods and products which can be purchased online. The orders may by placed via the Befsztyk.pl website.


2. Delivery area
a) Services offered by Befsztyk.pl are available only within the Warsaw city area. 
Deliveries outside the city limits may be allowed. These deliveries will be individually arranged with the Customer by e-mail or by phone.


3. Customer
The services offered via the Befsztyk.pl website are available only to adult physical persons who have a full capacity defined by the civil law to legal transactions as well as to separate legal persons.

4. Sale of alcohol
Sale of alcohol via the Befsztyk.pl website is exclusively available to persons over the age of 18. The deliverer of Befsztyk.pl is entitled to request a formal identification confirming the date of birth of a person who accept the delivery of an order including the alcohol. In the case there is no possibility to accept the order by a person over the age of 18 or presentation of identity card is refused the deliverer of Befsztyk.pl is obliged not to handover the alcohol.


5. Pricing policy
The prices for products and delivery charges stated on the Befsztyk.pl website are gross prices [including VAT], shown in PLN [Polish zlotys].


6. Submitting an offer
Placing an order by the Customer is equivalent to submitting an offer in the meaning of civil law provisions. Sending an e-mail itemized order confirmation to the Customer by Befsztyk.pl constitutes the acceptance of the offer within the scope possible to be effected. All the products shown on the store website are subject to availability. If an ordered product is out of stock we reserve the right not to deliver it.

7. Sale agreement and pricing policy
Sale agreement is concluded between the Customer and the store Befsztyk.pl at the moment of delivering the order along with the receipt or the VAT invoice to the Customer. The product prices are binding at the moment of acceptance of the order placed by the Customer and therefore that prices are always used when issuing the sale document regardless the delivery date.


8. Delivery and delivery charge
The deliveries are made by the deliverers of Befsztyk.pl.

The delivery charges depend on the total order cost. Orders of a gross value from 100 PLN to 299,99 PLN will be charged 15 PLN for delivery. Orders of a gross value over 300 PLN will not have a delivery charge applied. As it is stated above the deliveries outside the city limits may be allowed. In that case the delivery charge will be calculated individually.

The orders of a total gross value under 100 PLN will not be delivered. If the Customer has placed an order of the gross value under 100 PLN, the Befsztyk.pl representative will contact the Customer by phone or by e-mail with an intent to make changes to the order or to cancel it.


III. PLACING AN ORDER 

1. Placing and completing the Order
Orders are placed by selecting items offered on the Befsztyk.pl website. To add an item to your virtual shopping cart  click on the “Add to cart” button. To complete your order you must click on the “Checkout” button.


2. Confirmation and fulfilment of the Order
Once the order has been placed by the Customer an e-mail order confirmation will be sent to the Customer. Next you will be sent a second e-mail confirming that your order is being fulfilled and containing the exact amounts of items that have been ordered and the total cost shown in PLN. Whenever it is found justified a Customer’s order may need to be verified by phone before initiation of its fulfilment. Befsztyk.pl reserves the right to cancel any order.

3. Order cancellation 
The Customer has the right to cancel any order provided that the cancellation is done till 3 p.m. the day before delivery. In case if the delivery is scheduled on Monday the cancellation must be done till 12.00 noon on Saturday before the delivery.


4. Delivery date and time
a) Delivery time can be adjusted the Customer’s schedule. Orders placed till 3 p.m. on workdays or till 12.00 noon on Saturdays will be delivered the next day (except Sundays and holidays) between 10.00 a.m. and 6p.m. or 10.00 a.m. and 2 p.m. on Saturdays. You may book the delivery for more then one day in advance. To select the most convenient delivery time please note the delivery day and time while completing your order. Type a note in the "Add comment to your order" field on the "Delivery information" page. 

b) If the delivery date and time is not specified by the Customer, the order will be delivered – depending on the time when the order was placed – within two workdays maximum (except Sundays and holidays) at the time selected by Befsztyk.pl which will be confirmed by mail or by phone.

c) Befsztyk.pl reserves the right to change the delivery date and time selected by the Customer due to logistic problems. In such a case Befsztyk.pl will inform about the change of the delivery time by e-mail or by phone.

d) Orders may be also collected personally in our store Befsztyk seated 02-715 Warszawa, ul. Puławska 176/178 between 10.00 a.m. and 7 p.m. on workdays and between 10.00 a.m. and 2 p.m. on Saturdays.

5. Holidays
Orders are not delivered on Sundays and holidays. Befsztyk.pl reserves the right to fix additional days off. Deliveries will not be available on these days.

6. Delivery address and time
According to the instructions given by the Customer the order will be delivered to the address specified by the Customer within the selected time slot. The Customer can specify the most convenient delivery date and time while completing the order. Befsztyk.pl will be under no liability for any delay or failure to deliver the products within the selected time due to any events and situations outside its reasonable control.


7. Order refusal
Befsztyk.pl reserves the right not to
fulfil the order in the following cases:

a) If there are serious doubts about the Customer.

b) If the order failed to be confirmed though Befsztyk.pl had required it.

c) If the Customer does not obey these Terms and Conditions.

d) If the order may not be fulfilled due to logistic issues.

8. Invoice
a) An itemized VAT invoice or receipt is always attached to the order. Befsztyk.pl must be authorized by the Customer to issue VAT invoices without the receiver’s signature.

b) VAT invoice can be issued on demand. Therefore the Customer must enter a company name and NIP number (tax identification number) while registering.


IV. PAYMENTS

1. Payment options.
 
The following payment options are accepted:

a) credit card or cash at delivery

b) credit card or cash at collection in the Befsztyk store seated 02-715 Warszawa, ul. Puławska 176/178


2. Pricing policy
Befsztyk.pl offers for sale products of variable weight. These products are especially marked on the product description page. Prices of these products shown on the Befsztyk.pl website are estimated prices. The final price for the product of variable weight is calculated on its actual net weight. Both the product weight and its final price are indicated in the e-mail order confirmation and as well as on the VAT invoice or the receipt.

When ordering a product of variable weight the Customer always has to accept its final price.

V. DELIVERY

1. Deliverer 

The deliverer of Befsztyk.pl must provide his identity card on the Customer’s demand. Delivery will be made to the address specified by the Customer when ordering. The deliverer is not entitled to verify the identity of the receiver. However orders including alcohol may only be received by an adult person.  


2. Missed delivery
In case if no one is available to accept the delivery at the address indicated while ordering within the specified time slot, the deliverer of Befsztyk.pl shall try to contact the Customer by phone. If it is possible to arrange an alternative delivery time the deliverer of Befsztyk.pl will try to deliver your order within the rearranged time. In such a case a re-delivery fee of 15 PLN will be charged. Befsztyk.pl cannot be held responsible for any damage to the products (especially perishable goods, fresh foods and products of a short expiration date) caused by the delayed or missed delivery for which the Customer is responsible. The Customer may not to refuse to accept these products without paying the selling price.

3. Delivery refusal
Unjustified refusal to accept the delivery will be considered as the violation of these Terms and Conditions. The Customer may not to reject the delivery if some items are unavailable.


VI. CLAIMS AND RETURNS

1. Delivery errors / product damage
If whilst inspecting the products delivered by the deliverer of Befsztyk.pl, the Customer identifies any products which do not correspond to the placed order, he is entitled to decline products he did not order and to return them to the deliverer. Acceptance of the delivery confirmed with the Customer’s signature on the delivery form shall be considered as confirmation of the delivery conformity with the placed order.


2. Complaints and returns
a) If the delivered goods are inconsistent with the agreement the Customer is entitled to demand the product replacement, the price reduction or the cancellation of the agreement provided that the Customer notifies the store of this fact within 1 day from the delivery day. In order to file a complaint the Customer needs to contact the Befsztyk.pl store by e-mail or by phone.

b) All complaints shall be investigated within 7 days. The Customer shall be notified about the result of the complaint investigation in writing by e-mail or by post. Failure to respond to the complaint within the above-mentioned period of time will be considered as the complaint upholding.

The store is obliged to pay a refund to the Customer’s account for the returned/claimed products within 7 days from the day when the complaint has been upheld. The product returning fee will not refunded.

c) Befsztyk.pl will not receive any shipping returned cash on delivery.

d) Difference between the image of the product shown on the Befsztyk.pl website and its actual appearance may not be the reason to lodge a complaint and return the purchased product.


VII. FINAL PROVISIONS 

1. Obligation to provide truthful information
While registering on the Befsztyk.pl website the Customer is not allowed to provide incorrect or illegal information. Orders containing such information will not be fulfilled. Befsztyk.pl is not responsible for any information provided by the Customer.


2. Sending e-mail massages
Befsztyk.pl can not be held responsible if the e-mail massages sent to the e-mail account appointed by the Customer are not received, which may result both from e-mail blocking and deleting by the software installed on the computer used by the Customer and massages blocking by the e-mail server administrator.


3. Refunds
In case if the order is not to be fulfilled according to these Terms and Conditions or if the already paid order has been canceled by the Customer, Befsztyk.pl will refund the full amount to the account number specified by the Customer. The Customer will not entitled to any other refunds.  


4. Privacy policy
a) By registering on the Befsztyk.pl website the Customer expresses consent to personal data processing by Befsztyk.pl within the scope necessary for order
fulfilment, offer optimisation and communication with the Customer.

b) The administrator of Customer Personal Data is Befsztyk.pl. In accordance with the provisions of the Act on Personal Data Protection of 29 August 1997 (Journal of Laws No. 133, item 883) personal data must be protected in order that they are not disclosed to the third parties.

c) Any personal data from which the Customer can be identified are stored only as long as necessary for the purpose of data processing to be achieved. Registered Customers have right to access and rectify their Personal Data collected on the website.

d) Provided that the registered data do not comply with the actual personal data the Customer is entitled to access and rectify the data through the Befsztyk.pl website after logging in. The Customer is entitled to request data removal which must be sent from an e-mail account specified while registering. Befsztyk.pl reserves the right to confirm the authenticity of the request.

e) The Customer agrees to receiving emails directly related to processing of the order placed by the Customer and to technical changes made on his account.

f) Befsztyk.pl will never send e-mails requesting Customer’s data verification or second registration on the Befsztyk.pl website by clicking on the hyperlink specified in an e-mail message. Therefore Befsztyk.pl will not be responsible for consequences of disclosing the Customer’s personal data on the websites imitating the Befsztyk.pl site.


5. Changes to Terms and Conditions
Befsztyk.pl reserves the right to change these Terms and Conditions without
notifying the Customers registered on this website. Any modifications of these Terms and Conditions are effective from the moment of their publication on the Befsztyk.pl website.


6. Litigations
Any disputes arising in connection with these Terms and Conditions shall be settled by the court competent for the registered seat of Befsztyk.pl.
